Consultation on the Reliance on Proprietary Data for the Purpose of Re-evaluation and Special Review, Discussion Document DIS2012-01

The Pest Management Regulatory Agency (PMRA) invites stakeholders and the public to submit written comments on Discussion Document DIS2012-01, Reliance on Proprietary Data for the Purpose of Re-evaluation and Special Review.

The data protection provisions of the Pest Control Products Regulations came into force on June 3, 2010, following stakeholder engagement and consultation. These provisions modernize Canada's pesticide data protection system, encouraging innovation, timely grower access to competitively-priced generic pesticides and provide incentives to industry to register their pesticides for use on minor crops such as fruits and vegetables.

As per the regulations, the data protection provisions also apply to re-evaluation and special review situations, with any necessary modifications. Data used by the Minister to confirm the registration following a re-evaluation or special review decision may require compensation if the data is owned by another registrant.
