Under the authority of the Pest Control Products Act, Health Canada's Pest Management Regulatory Agency (PMRA) has established maximum residue limits (MRLs) for fludioxonil in or on citrus fruits (Crop Group 10; see Appendix I), citrus oil, kiwifruits, pomegranates and true yam tubers to permit the import and sale of food containing these residues.

Corresponding MRLs were proposed in the consultation document published on 1 November 2007, Proposed Maximum Residue Limit PMRL2007-13, Fludioxonil. Appendix II summarizes the comments received during the consultation process and provides the PMRA's response to these comments, which did not impact the MRLs established below.

To comply with Canada's international trade obligations, consultation on the proposed MRLs was also conducted internationally by notifying the World Trade Organization, as coordinated by the Standards Council of Canada. No comments were received as a result of the World Trade Organization consultation.

The following MRLs are legally in effect as of the publication date of this document and have been either revised or added to the MRLs already established for fludioxonil.

Appendix II Comments and Responses

Comment

A request was made to increase the proposed 1.7 ppm MRL for fludioxonil in or on pomegranates to 5.0 ppm to harmonize with the corresponding tolerance established in the United States.

Further residue trials were not submitted in support of the increased MRL. However, monitoring data for pomegranates processed in commercial packing houses from 2001 to 2007 were provided. Four of the 93 data points reflected residues above the 1.7 ppm MRL proposed in Canada (2.2, 2.8, 3.0 and 4.5 ppm).

The respondent believes that a 5.0 ppm MRL is necessary for the practical and free movement of pomegranates into Canada and to avoid a trade irritant issue.

Response

The PMRA acknowledges receipt of the request to revise the MRL for fludioxonil in or on pomegranates but is not prepared to accept the monitoring data as the basis for increasing the MRL. As such, the respondent has been informed of the need for an application to increase the MRL by providing scientific data.
