Natural Health Products Online System Trading Partner Guide

About This Guide

The objective of this document is to provide a summary of information for Trading Partners who will be users of the Online System, provided by the Natural Health Products Directorate of Health Canada.

1. Introduction

1.1 Overview

This document is intended to provide a summary of information for electronic users of the Online System provided by the Natural Health Products Directorate (NHPD) of Health Canada.

The NHPD has created the Natural Health Products Online System that allows applicants to send information electronically. Anyone who wishes to conduct business electronically with NHPD, either on their own behalf or on behalf of someone else, can use the electronic submission features of the Natural Health Products Online System. By "anyone" this includes:

  • Applicants submitting a product licence application or site licence application;
  • Representatives in Canada for an applicant with an address outside of Canada; and
  • Designated third-party entities (i.e. consultants).

However, before applicants can use the system for electronic submission, they must first enrol. Enrolment is required to establish the credentials necessary to identify and authenticate an applicant in an electronic context. Once enrolled, applicants and their representatives are recognized as Trading Partners and are able to conduct business electronically with the NHPD using PosteCS™ secure e-mail.

1.2 Online Submission Process

1.2.1 Objectives

A key objective of the Natural Health Products Online System is to establish an end-to-end process for the electronic exchange of protected information between the NHPD and applicants.

The service selected for this purpose is PosteCS™ from Canada Post. This is a secure document delivery service providing enterprises with the ability to send content-sensitive documentation quickly and efficiently while receiving real-time evidence of the completed transaction. Pilot participants simply sign up for the service, and then are provided with an invoice based on a monthly transaction volume of the amount of packages that have been sent.

An overview of the submission process using PosteCS is shown below in Figure 1.

1.3 PosteCS™

As part of the licensing process, the NHPD exchanges various documents electronically with its Trading Partners using the Canada Post secure e-mail system PosteCS. This service provides secure transport for licence application documents and any related correspondence between applicants and the NHPD.

For electronic exchange, the user is required to subscribe to PosteCS which is a secure e-mail service that supports security measures such as:

  • Data encryption: The ability to encrypt and decrypt electronic messages and file attachments.
  • Electronic signature: The means to electronically "sign" data and documents to confirm the identity and intent of the sender of information as well as ensuring the integrity of the data that is received.
  • Non-repudiation: A means to defend against a claim of denial of making a transaction in Natural Health Products Online. Techniques used include timestamp, transaction logs, and storing the transaction data for future reference.

For these features to work properly, the Trading Partner must configure the PosteCS account security preferences. Specifically, for New Package Preferences, the Security selection must be Account Password Protection. This setting ensures that messages sent by the Trading Partner can only be received by another PosteCS account.

A Trading Partner must use the PosteCS service to transmit electronic documents when either:

  • The document(s) being sent contain(s) a location for signature;
  • The message or attachments being sent refer to key details of the licence application such as product name, tracking/submission number or ingredients; or
  • The information being sent is Business Confidential or is not in the public domain.

Using the PosteCS secure e-mail system is similar to using other Web-based electronic mail software (such as Microsoft Outlook, Lotus Notes Mail, Microsft Network (MSN) Hotmail, Yahoo Mail etc.) Using an active Web browser, a Trading Partner is able to log on to the Canada Post's PosteCS site with a valid Identification (ID) and password. Any new message received will be in the Trading Partner's Inbox.

Canada Post also sends a notification about a PosteCS message to the Trading Partner's regular e-mail system. See example below.

1.4 System Requirements

The following is the recommended workstation configuration to prepare and to submit the electronic forms associated with the Natural Health Products Online System:

  • IBM Compatible PC
  • 1.6 GHz - Pentium IV Processor
  • 1 GB of RAM
  • Windows 2000 with Service Pack 4 or XP with Service Pack 2 as operating system
  • Internet Explorer 6.0 or higher
  • High-speed internet connection

  • Storage capacity of at least 10 Mb disk space per submission (equivalent of 200 - 2,000 single-sided pages depending on electronic format and graphics content of supporting documentation)

In addition to the above, the browser must have the following features:

  • Support Secure Sockets Layer (SSL) 3.0 - 128-bit encryption
  • JavaScript enabled
  • Cookies enabled
  • The Sun Java Virtual Machine (JVM) 1.4.2_03 or later running

While it is possible to operate at a reduced performance level with lower-capacity or alternative hardware, the software specifications must be respected to successfully use the electronic forms.

2. Registration and Enrolment

2.1 Roles and Responsibilities

Trading Partner: The Trading Partner is an entity that has the status of a person in law-either a natural person who may or may not have a registered business name, or one created by law to conduct commercial business, such as a corporation, partnership or co-operative-who wishes to securely conduct business with the NHPD through the Internet.

Primary User: The Primary User is an officer or employee of the Trading Partner who is duly authorized to sign the Trading Partner Agreement on behalf of the organization. For those Trading Partners that are Sole Proprietors, the name proprietors may be the Primary Users for Natural Health Products Online. Each Trading Partner has only one Primary User. The Primary User is responsible for completing the enrolment package and submitting it to the NHPD. Once the enrolment is complete, the Primary User will be able to authorize additional Delegated User accounts as necessary to support the business needs of the Trading Partner. The Primary User will also be able to revoke an existing Delegated User at any time. The NHPD will verify and refuse access to anyone that is not authorized to transact on behalf of the Trading Partner. The Primary User will be notified by electronic mail (PosteCS) if an unauthorized person attempts to act on behalf of the Trading Partner.

Delegated User: The Delegated User is a person designated by the Primary User for the purposes associated with Natural Health Products Online. When the Primary User has authorized Delegated Users and the NHPD has activated their NHP Online accounts, Delegated Users may begin transacting via Natural Health Products Online. Delegated Users have no authority to create accounts for others and their access rights are managed by the Primary User who authorized them as a Delegated User.

  • May be a natural person or an entity created by law to conduct commercial business;
  • Has one and only one Primary User.
  • An actual person who signs the Trading Partner agreement (proof of authority to sign required);
  • Is held accountable by NHPD for all electronic activity on behalf of the Trading Partner;
  • Can delegate or revoke authority to others (Delegated Users) to transact electronically with NHPD on behalf of the Trading Partner but is still held accountable for this activity.
  • An actual person who has been designated by the Primary User to transact electronically with the NHPD on behalf of the Trading Partner;
  • Number of Delegated Users for a Trading Partner ranges from none to unlimited;
  • Delegation of authority is not specific to any particular application submission; this delegation remains in effect until revoked by the Primary User.

2.2 Enrolment Process

2.2.1 Overview of the Enrolment Process

A summary of the enrolment process is provided in Figure 3 below:

2.2.2 Process Initiation

The enrolment process begins by downloading the Natural Health Products Online System Enrolment Package from the NHPD Web site.

The Enrolment Package is a zipped file that consists of the following:

Each document should be reviewed beginning with the Natural Health Products Online Solution: Electronic Product Licence (e-PLA) Application Guide, before completing any of the enrolment forms.

2.2.3 Preparation of the Enrolment Application

Typically the Primary User completes the components of the enrolment application. The Primary User must sign the Trading Partner Agreement and the Trading Partner Profile Form for them to take effect.

2.2.3.1 Step 1: Complete the Trading Partner Agreement

The Trading Partner Agreement sets out the terms and conditions under which the NHPD will make the Natural Health Products Online System available to the Trading Partner for the purpose of submitting information. A Trading Partner must be either:

  • A sole proprietor carrying on business under the true name of the owner (a natural person) or under a business name (for example - has a registered business name and/or number);
  • A business corporation; or
  • A partnership.

A sole proprietorship doing business under a different name from the true name of the owner must indicate both its legal (registered) name and its trade name on the Trading Partner Agreement and in block A. - Trading Partner: Trading Partner Legal Name of the TPP. A partnership should also set out the names of the partners.

The following are examples of situations where a business or someone is not eligible to become a Trading Partner:

  • A business unit of convenience within the organizational structure of a corporation which does not hold a distinct legal status (for example - "Division of ...").
  • A sole proprietorship or corporation having a confirmed address outside Canada and lacking a representative with an address in Canada. This representative must be identified on the Trading Partner Profile Form as a Delegated User.
2.2.3.2 Step 2: Complete the Trading Partner Profile Form

The Trading Partner Profile form must be completed using the Adobe Reader software. This ensures that the applicant has the proper hardware capacity and software installed to use the electronic forms for Natural Health Products Online. The first part of the form asks that the applicant identify the application as either a new application or a modification of an existing profile (see Figure 3 below.) For enrolment purposes, this form is used by selecting New Trading Partner Profile.

The remainder of the form is used to identify the Trading Partner and Primary User information that is set up in the Natural Health Products Online System once the application has been approved.

Part 1A Trading Partner

In this section of the form, the applicant fills in the Trading Partner information, including contact information. Trading Partners are asked to identify memberships in any councils or associations relevant to natural health products. If the Trading Partner is a member of any associations not listed, they can be added by selecting the Add a Membership button in the bottom right-hand side (see Figure 4 below.)

Part 1B Primary User

In this section of the form, the applicant fills in the Primary User information. There are situations set out within the Trading Partner Agreement where the NHPD needs to contact the Trading Partner, such as to give notice or provide notifications, or for general communication purposes about Natural Health Products Online. In these situations, the NHPD contacts the Primary User using the information provided in this section. See Figure 5 below:

Following enrolment, the Primary User is responsible for informing the NHPD of:

  • Matters identified in the Natural Health Products Online Trading Partner Agreement;
  • Any changes to the information provided in the Trading Partner Agreement such as a change of legal name; and
  • Any changes to the information provided in the Trading Partner Profile Form prior to completion of initial Natural Health Products Online system enrolment.
Part 1C Shared Secrets

The NHPD uses this section (see Figure 6) to authenticate the identity of the Primary User, both during the enrolment process and later when requesting updates to the Trading Partner profile. The answers to these pre-determined questions should be brief, unique to the individual, and easy to remember. During screening of the enrolment application, if the applicant is unable to provide these answers, the NHPD will terminate the enrolment process and decline the request for enrolment.

Part 2 Delegated User

The applicant can use the enrolment opportunity to identify other users who are authorized to transact electronically on behalf of the Trading Partner. These are known as Delegated users. Delegated Users may be added or revoked by the Primary User at any time after enrolment. To add more than one Delegated User, select the Add A Delegated User button (see Figure 7 below.)

Pen and Notepad Icon Note: Trading Partners with an address outside Canada must have at least one Delegated User identified with a Canadian address. This person is expected to fulfill the role of Representative for all submissions.

Changes to any part of the Trading Partner profile are communicated to the NHPD by the Primary User sending an updated Trading Partner Profile Form (see Section 3 -Maintain Trading Partner Information.) Before completion of enrolment, this information must be sent by regular mail or by courier. At all times, avoid sending protected data (such as personal information) by regular e-mail unless PosteCS is used.

Attestation

This last section of the Trading Partner form requires the Primary User to sign and date the form. By selecting the Finalize button (see Figure 8 below), the Primary User can verify that all required information fields have been properly completed.

2.2.3.3 Step 3: Provide proof of legal capacity to sign the Trading Partner Agreement on behalf of the Trading Partner.

The applicant must collect and assemble copies of the Primary User's proof of legal capacity to sign the Trading Partner Agreement on behalf of the Trading Partner. There are two types of supporting documents required:

  1. Proof of the legal name of the Trading Partner; and
  2. Authorization that the named Primary User has the legal authority to sign on behalf of the Trading Partner.

The supporting documentation will depend on the individual Trading Partner circumstances.

  1. Proof of the legal name of the Trading Partner:

    For a corporation, any one of:

    • Certificate of Incorporation (showing incorporated name, business address and officers); or
    • Letters patent or any other official incorporation document.

    For a natural person who has a registered business name, any one of:

    • Business Registration; or
    • Goods and Services Tax notice from the Canada Revenue Agency.

    For a partnership:

    • The partnership agreement (showing partnership name, business address and names of partners).
  2. Authorization that the named Primary User has the legal authority to sign on behalf of the Trading Partner

    For a corporation, any one of:

    • Certificate of Incorporation (naming the Primary User as an officer); or
    • Letter stating that the named Primary User has the legal authority to sign on behalf of the Trading Partner; letter must be written on corporation letterhead signed by one of the officers named in the Certificate of Incorporation. A blank Signing Authority template is provided as a model.

    For a natural person who has a registered business name, any one of:

    • Registration; or
    • Goods and Services Tax notice from the Canada Revenue Agency.

    For a partnership:

    • The partnership agreement (showing partnership name, business address and names of partners including the Primary User.)

2.2.3.4 Step 4: Submit the Enrolment Application

Now that the application form has been completed, and all supporting documentation has been gathered and prepared, the Primary User is ready to submit the completed enrolment package. Because the enrolment application requires that signed originals be delivered to the NHPD, delivery may not be carried out online. Therefore, the enrolment package must be submitted to the NHPD by regular mail or courier (fax and regular e mail submission will not be accepted) at:

The completed enrolment package must include:

  • Two signed, original copies of the Trading Partner Agreement;
  • One completed and signed original Trading Partner Profile Form; and
  • Proof of legal capacity to sign on behalf of the Trading Partner.

Enrolment requests will not be processed without appropriate and complete supporting documentation.

The Primary User may check the status of the enrolment request by contacting the Natural Health Products Directorate by e-mail at nhpd_dpsn@hc-sc.gc.ca.

2.2.4 Enrolment Application Screening

Review of the enrolment application begins once the complete package is received at the NHPD. The Primary User is contacted by telephone using the information provided, if the NHPD has any questions or requires any clarifications about the enrolment package contents. Using PosteCS™, the NHPD contacts the Primary User to schedule an interview. This telephone interview with the Primary User is to confirm the contents of the Trading Partner Profile that was included as part of the enrolment submission. The NHPD will then make a decision to approve or decline the enrolment based on the results of the interview and contents of the application.

If the enrolment application is approved, then NHPD performs several internal activities, including:

  • Activate the Trading Partner Natural Health Products Online System account; and
  • Set up the Primary User and any Delegated Users for the Trading Partner.

These internal activities are transparent to the Trading Partner. After a successful enrolment, the Trading Partner receives the following:

  • A confirmation message (sent to the Primary User by PosteCS secure e-mail); and
  • A signed copy of the Trading Partner Agreement (sent by regular mail.)

All other information regarding the preparation and submission of applications is available on the Natural Health Products Directorate Web site.

Upon confirmation of enrolment, the Trading Partner can submit licence applications and supporting documentation electronically

3. Maintain Trading Partner Information

The Trading Partner Profile (TPP) form that was initially used during the enrolment process can also be used to maintain Trading Partner information, including:

3.1 Trading Partner Address

When modifying Trading Partner information, the Trading Partner Legal Name and Trade Name must be completed. Some changes require supporting documentation.

If the Legal Name of the Trading Partner needs to be modified, a new Trading Partner Agreement (TPA) will be required. Refer to Section 2.2 - Enrolment Process regarding the procedures for submitting a new TPA.

3.2 Primary User Address Information

Not all information relating to the Primary User can be modified using the Trading Partner Profile form; only the Primary User information highlighted (see Figure 10) can be modified. If the Primary User Name, Organization Name, or PosteCS™ Address must be modified, a new TPA is required as this is a material change. Refer to Section 2.2 - Enrolment Process regarding the procedures for submitting a new TPA.

When modifying Primary User information, the Trading Partner Legal Name and Trade Name in block A - Trading Partner, as well as the Primary User Name and the PosteCS Address in block B - Primary User must be completed (see Figure 11 - Mandatory Fields below.)

3.3 Shared Secrets

All information within Block C Shared Secrets can be modified. However, when modifying Shared Secrets, the Trading Partner Legal Name and Trade Name in block A - Trading Partner as well as the Primary User Name and the PosteCS™ Address in block B - Primary User information must be provided (shown in Figure 11 - Mandatory Fields above.)

3.4 Maintain Delegated Users

All information in Part 2 - Delegated Users is modifiable. However, when managing Delegated Users, the Trading Partner Legal Name and Trade Name in block A - Trading Partner as well as the Primary User Name and the PosteCS™ Address in block B - Primary User are required (shown in Figure 11 - Mandatory Fields above.)

When making changes to the Delegated Users section, specify (as in Figure 12 - Delegated User below):

  • Add (to add a new Delegated User)
  • Modify (to modify information about an existing Delegated User)
  • Revoke (to revoke the access of an existing Delegated User)

Multiple Delegated Users can be managed on the same form. To make changes to more than one Delegated User, select the Add a Delegated User button.

Provide the name of the Delegated User and the information needed to contact that individual, for example, organization name (if different from the Trading Partner), full mailing address, telephone and fax numbers, position/title, e-mail address, and language preference. The full mailing address is not required if the Delegated User has the same address as the Trading Partner identified in "Part 1 - Block A".

Each Delegated User must have a unique PosteCS™ Address; otherwise the enrolment will be rejected by the NHPD.

Pen and Notepad Icon Note: Since the PosteCS™ Address uniquely identifies a Delegated User, it is not modified. To change the PosteCS™ Address, first Revoke the Delegated User and then Add the Delegated User back with the new PosteCS™ Address.

3.5 Attestation

Since the completed Trading Partner Profile form is sent to the NHPD using PosteCS, a signature is not required when making modifications to an existing profile. The form will automatically insert the Primary User Name in the signature block.

When saving the Trading Partner Profile (TPP) form, use the appropriate acronym (such as TPP), iteration number, and date to create a unique file name.

4. Electronic Submission

The details of the submission process are described in the Natural Health Products Online Solution Electronic Product Licence Guide.

The Natural Health Partner Directorate Trading Partner enrolment process essentially establishes the PosteCS™ address of each individual as the electronic equivalent of a personal signature. For this reason, it is essential that Trading Partners secure the identifier and password for each PosteCS™ address. Each user should protect the password in the same way a Personal Identification Number (PIN) or electronic banking access code would be protected; passwords should never be shared or kept in a place where they can be found by others.

Trading Partners are enabled to submit NHPD forms including licence applications and supporting materials electronically. However, there are some basic concepts to keep in mind when conducting business electronically with the NHPD:

4.1 Multiple PosteCS™ Addresses

The NHPD has multiple PosteCS addresses.

There are two main NHPD PosteCS addresses to receive Trading Partner messages:

Like Trading Partners, the NHPD has individual PosteCS accounts for its officers. A Trading Partner may receive a message from a PosteCS address with the following format:

NHP_POSTECS_PSNnnn@hc-sc.gc.ca where nnn is a 3-digit number

For messages received from the NHPD, Trading Partners are strongly encouraged to respond to the appropriate main address in all cases. The message will then be routed to the proper individual, or to an alternate if the original author of the message is unavailable. Should a Trading Partner choose to reply to the originating officer directly, there is no possibility for the NHPD to reroute the message to another officer, if the originator is unable to access the PosteCS account. A Trading Partner can always decide to send a reply to both the originator and to the main account, knowing that the PosteCS message cost is per address.

4.2 Virus Scanning

Incoming PosteCS messages are scanned for viruses before being opened.

If an incoming message (file attachments specifically) fails virus-checking, the NHPD replies to the sender with an appropriate message.

4.3 PosteCS™ Messages Must Come from 'Active' Status Senders

The Sender of an incoming PosteCS message must be enrolled and in 'active' status.

If the sender's PosteCS address is known but the sender is not in 'active' status (for example has been revoked), the email will be forwarded to the Primary User with an appropriate message.

If the sender's PosteCS address is unknown but the Trading Partner can be identified through the licence application or attachments, the e mail will be forwarded to the Primary User with an appropriate message.

If the PosteCS address is unknown and the Trading Partner cannot be identified through the licence application or attachments, the e-mail will be returned to sender with an appropriate message.

4.4 Electronic Correspondence Only with Enrolled Users

Electronic correspondence regarding submissions is conducted only with enrolled Trading Partner Users named in Part 1 of the licence application.

Any enrolled user may send information - including licence application submissions to the NHPD on behalf of its Trading Partner. However, NHPD security and integrity procedures require that outgoing electronic communication regarding a licence application can only be sent to enrolled users that are named in Part 1 of the licence application. If none of the individuals in Part 1 is an enrolled user, the communication is sent to the Primary User.

4.5 Transactions are Conducted with the Primary User Only

Since the Primary User has confirmed signing authority on behalf of the Trading Partner, the Primary User is the exclusive contact for the NHPD in the following situations:

  • Changes to the Trading Partner profile;
  • Notifications as detailed in the Trading Partner Agreement; and
  • Issues regarding senders claiming to act on behalf of the Trading Partner (for example Delegated Users);

4.6 Active Primary User Must be Enrolled at All Times

The Trading Partner must ensure that an active Primary User is enrolled at all times.

As per the Trading Partner Agreement, the Trading Partner must replace the Primary User should that person no longer be able to fulfill his or her obligations on behalf of the Trading Partner. A Trading Partner could operate temporarily without a Primary User and continue to conduct business electronically. However in the circumstances described elsewhere in this chapter, it may become impossible to continue if Trading Partner authorization or action is required. Example: an electronic licence application is received but none of the individuals named in Part 1 is an enrolled user. The NHPD normally responds to the Primary User in this situation, but would be unable to communicate with anyone electronically if the Trading Partner had no active Primary User. Communication would then be conducted by regular mail or fax in this situation.
