Exemptions from mandatory food ingredient labelling

The following foods continue to be exempt from ingredient declaration under section B.01.008 paragraph 2 * of the Regulations:

  • pre-packaged foods made and sold at the same retail store;

  • prepackaged meat, poultry and their by-products that are barbecued, roasted or broiled on the retail premises;

  • pre-packaged sandwiches made at a commissary and sold through automatic vending machines or mobile canteens;

  • pre-packaged individual portions of foods served by a restaurant or other commercial enterprise with meals or snacks such as condiments or crackers;

  • prepackaged alcoholic beverages with compositional standards set out in Division 2 of the Regulations;

  • prepackaged vinegars with compositional standards set out in Division 19 of the Regulations;

The following foods continue to be exempt from carrying a label under section B.01.003 (a)* of the Regulations:

  • pre-packaged one bite confections sold individually;

  • prepackaged fruit and vegetables that are packaged in a wrapper or confining band of less than one-half inch in width.

However, if a manufacturer chooses to include a list of ingredients on the label of one of these foods, then all priority allergens, gluten sources and added sulphites are to be declared.
